NOAA’s Fisheries Service has urged the U.S. District Court of Massachusetts to reconsider its order to temporarily suspend measures in place since 2006 that address overfishing, promote rebuilding of many groundfish stocks and provide fishing opportunities to target healthy groundfish stocks. According to the NOAA Fisheries Service press release, the court’s order may force more stringent management measures in the future.

The NOAA announcment comes in response to the January 26, 2009 injunction of Framework 42. The plaintiffs, the Commonwealth of Massachusetts Division of Fisheries, and the State of New Hampshire Department of Fish & Game, Division of Marine Fisheries filed the suit against the United States Department of Commerce. The Judge's order stated "The court temporarily suspends Framework 42 pending serious consideration and analysis of the Mixed-Stock Exception by Defendant."
